Administrativa avgiftspåföljder av straffkaraktär har under de senaste åren stått föremål för ett växande intresse och debatt i de nordiska länderna. Förevarande forskning kartlägger rättsläget gällande sanktionsavgifter i Finland samt Sverige, Norge och Danmark. I forskningen undersöks hur garantier för god förvaltning och rättvis rättegång kan säkerställas i förfaranden som gäller påförande av sanktionsavgift, samt överklagandet av dessa ärenden. I studien jämförs och analyseras dessa europarättsliga krav med de nationellrättsliga, nordiska undersökningar som utförts. Dessutom diskuteras principiella utgångspunkter som ska beaktas vid reglering av sanktionsavgifter. Forskningen har utförts av professor Leena Halila och doktorand Veronica Lankinen vid Juridiska fakulteten, Helsingfors universitet, samt universitetslektor Annika K. Nilsson, vid Juridiska fakulteten, Uppsala universitet.

Summary

This research project puts administrative penalty payments (administrativa sanktionsavgifter) in focus. Penalty payments have in recent years been the subject of growing debate in the Nordic countries. Penalty payments are administrative monetary sanctions inflicted as a result of a violation of the law, and they are comparable to criminal sanctions. They are imposed by an administrative authority or court on a natural or legal person. Administrative penalty payments are seen as effective instruments in supervision and control, and their regulation and application has hence increased significantly in the Nordic countries in the last few decades. In other words, the scope of monetary sanctions has been diversified. Today, penalty payments are especially used as effective means of regulation and control of business activities, where the need for rapid penalties, prevention and flexibility is emphasised. Elimination of economic gains obtained as a result of violations has also been given particular importance in this context. National legislation on administrative sanctions has also expanded as a result of the impact of EU law. Opportunities for imposing sanctions have often been incorporated into national legal systems with a view to streamlining the implementation of EU law in the Member States.
